Discuss the term tort and examine the foundations of tortuous liability. What are the fundamental differences between criminal law and tort law? (30 marks)
2.
Analyse the ‘Rule in Rylands v Fletcher’. Explain the exceptions to the rule. (20 marks)
3.
Broadly define the tort of nuisance. Who can sue and who can be sued in nuisance? (20marks)
4.
‘False imprisonment is the infliction of bodily restraint which is not expressly or impliedly authorized by law’ Discuss. (20 marks)
5.
Write short notes on any four of the following:
a) Res Ipsor Loquitor (5 marks)
b) Volenti non fit injuria (5 marks)
c) Novus actus interveniens (5 marks)
d) Contributory negligence (5 marks)
