Fundamental Rights and Freedoms in Kenya
Constitution 21 (1) ensures the state and state organs has the obligation to uphold the fundamental rights and freedoms of all.
S 26(1) ensures the right to life
S 27 protects individuals from discrimination, assigning equal benefit and protection of the law.
S 28 ensures the right to human dignity
S 29 assures the right to freedom and security of the person
S 30 ensures that no one shall be held in slavery or servitude, including forced labour
S 31 grants everyone the right to privacy
S 32 ensures individuals the right to freedom of conscience, religion, thought, belief and opinion
S 33 guarantees the right to freedom of expression
S 44 grants the media freedom from state control (2(a))
S 35 grants everyone the right to access to information held by the state, and other persons who have information required for the protection of fundamental rights and freedoms
S 36 freedom of association, including the right to form or join an association of any kind
S 37 gives everyone the right (peacefully and when unarmed) to assembly, picketing, demonstration and present petitions to public authorities
S 38 protects the political rights of the individual, by guaranteeing the freedom to make political choices
S 39 grants people the right to freedom of movement and residence
S 40 (1) ensures protection of the right to property
S 41 ensures the right to fair labour practices
S 42- grants everyone a right to a free and healthy environment, and s 70 ensures the enforcement of environmental rights
S 43 guarantees economic and social rights
S 44 right to use language and participate in a culture life of one''s choice
S 45 ensures the recognition of a family as the natural and fundamental unit of the society, and the necessary basis of social order, and assures it of the protection of the state
S 46 Consumer rights- ensures protection

of the consumers with respect to goods and services offered by public entities and private persons
S 47 grants right to fair administrative action
S 48 – rights of an arrested persons, and fair hearing
S 51 rights of a detained, held in custody or imprisoned person
