International Sources of Electoral Law

Electoral law is considered as one of the most elusive subjects especially in the Kenyan context. The main sources of electoral law include;
•The 1948 Universal Declaration of Human Rights at Article 21 where it is stated that every person is entitled to take part in the governance of his country, directly or a freely chosen representatives.
•The 1952 Convention on the Political Rights of Women
•The 1965 International Convention on the Elimination of All Forms of Racial Discrimination
•The 1966 International Covenant on Civil and Political Rights
•The 1979 International Convention on the Elimination of All Forms of Discrimination against women
•The 1948 American Declaration of the Rights and Duties of Man
•The 1950 European Convention on Human Rights: Protocol 1
•The 1969 American Convention on Human Rights
•The 1981 African Charter on Human Rights and People’s Rights
The main similarities that the documents have are that they enumerate most of the Universal Suffrage rights contained in the documents. Kenya being amongst the signatory members has adopted these provisions in its 2010 Constitution.
