QUESTION ONE
a) Kenya Airways has hired you as its human resource director, just after the former incumbent of
the office was forced to resign when employees went on strike due to a labour dispute. The
management wants you to expose the various employment Acts that are key to their operations
and explain how the legal provisions contained in these Acts can be implemented and adhered to
forestall future strikes and massive losses to the airline. [20 Marks]
b) Enumerate the main parties in the employment relationship. Highlight the legal provisions
governing each party to this relationship. [10 Marks]

a) Discuss the circumstances that may lead to summary dismissal of an employee in the
organization. [8 Marks]
b) Discuss the strike regulation in Kenya with regard to
i) Lawful strikes
ii) Unlawful strikes
iii) Strikes in essential services. [12 Marks]

a) Labour laws have a long and acrimonious history. Discuss the legal weapons of choice that
businesses used to control early unionizations efforts. [8 Marks]
b) The signing of an industrial relations charter was an important milestone in the evolution of
labour laws in Kenya. Discuss the main contents of the revised industrial relations charter and its
impact on labour in Kenya. [12 Marks]

a) What is collective agreement? [ 2 Marks]
b) Discuss the prerequisite conditions, which must be fulfilled before parties may proceed with the
collective bargaining process which is contained in the Trade Unions Act, the Trade Disputes
Act and the Industrial Relations Charter. [12 Marks ]
c) In employment relationships the employees or independent contractors have certain duties and
obligations to their employer. Discuss THREE of such duties. [6 Marks]
QUESTION FIVE
In May 2001 a Taskforce called the labour law reform agenda was appointed by the Attorney
General (Gazette Notice No 3204) to review the Labour Laws within the International Labour
Organization project. Discuss any TEN areas of labour regulation that was to be covered by the
taskforce. [20 Marks]
