a) Define the term “law” and state the main purpose of law in a society (6 Marks)
b) Explain the meaning of the term “delegated legislation “and state its advantages (6 Marks)
c) Discuss to what extent the African customary law will be considered as a source of law.

a) Discuss the terms which are implied in any hire purchase agreement. (10 Marks)
b) Distinguish between “sale” and “agreement to sell”. ( 5 Marks)
c) Highlight a guarantor’s rights against the debtor under the law of guarantee (5 Marks)
Question Three
a) Explain the meaning of the doctrine of privity of contract and the exceptions to this doctrine
( 8 Marks)
b) Outline the methods in which a contract may be discharged ( 6 Marks)
c) Janice offered to sell her house to a Alex for Sh 2million. Alex wrote a letter to her offering to
buy the house at Sh1.5 million. Janice did not respond to Alex letter and went ahead to sell the
house to Paul. Alex intends to institute legal proceedings for breach of contract and has come
to you for legal advice.
