Mps Strike a Deal on ”No confidence” vote – Nation 15/03/05.
Motion to send the President home would require a two thirds majority.
Mps have reached a consensus to back the Keter Bill if it is amended to state that Parliament
will require a 65 per cent majority to pass a vote of no confidence in the President.
The mover of the Bill, Belgut MP Charles Keter, agreed with a resolution spearheaded by
Mwea MP Alfred Nderitu which means that for a no confidence motion to succeed,
Parliament will have the support of 145 MPs out of the 222 Mps in the house. Mps from
various political parties who met at Serena Hotel, Nairobi were Mr. Keter – KANU, Justine
Muturi, William Ruto – KANU, Joseph Kamotho, Reuben Ndolo (LDP) Gachara Muchiri,
Alfred Nderitu, David Mwenje (NAK) and Ford People Omingo Magara.
The group met to find a solution to the constitution of Kenya amendment Bill which has
sparked intense debate ahead of Parliament opening – tomorrow.
Some Mps had said the clause that seeks to remove a President without having to dissolve
Parliament was aimed at impeaching President Kibaki. The current constitution provides that
both the President and the Mps seek a fresh mandate in the event of a no confidence motion,
which requires only a simple majority.
The Bills principle objective is to have Parliament set and regulate its own calendar as
opposed to the present constitution where only the President has the power to summon and
dissolve Parliament.
The MPs said that the consensus reached by the 10 parliamentarians would unite the entire
House to back the Bill which must be published afresh before it is reintroduced in
Parliament.
