INSTRUCTIONS:
Answer question ONE and any other TWO questions.
1.
After his university studies, Mr. Ben secured a job with a company Kazi Ltd. as a
human resource manager.

Ben, an employee who is about to retire would like some advice on how he
arrange the affairs of his estate to ensure a smooth transition on his death. Pen
who is not very clear on how to proceed has requested for your assistance. Write
a memorandum to Mr. Ben explaining the following:

(i)
The essential requirements of a valid will.

(10 marks)

(ii)
The difference between a written will and an oral will.
(5 marks)

(iii)
The role of an executor.




(5 marks)
(iv)
The rules applicable in the division of a deceased person’s estate in
intestate succession.

A borrowed money from B on the understanding that it would pay it back in 30
days. On the due date b demanded the money. B wrote a cheque payable to A on
his order. The cheque was generally crossed. C stole the cheque from B, forged
B’s signature and negotiated it to D who took of for value and in good faith. D
deposited the cheque with his bank Dole limited which presented it Axis Bank
for payment. B has not discoursed that the cheque is missing and has come to you
for advice on the following:

(i)
Whether he can demand another cheque from A.

(ii)
The liability of C
(iii)
Liability of D.
(iv)
The liability of Dole Bank
(v)
Liability of Axis Bank
Q. 3 The rules of the law of evidence came generally about the exclusion of evidence
that a lay person may consider relevant. Discuss.

Q. 4 Otieno a 70 year old man owns a piece of land in Nyahera. He would like, on his
death, to bequeath it to his son Omondi. But he would want his wife Nyabel to
live on it for the most of her life. Joh, Otieno’s neighbour has been cultivating the
land and paying a rent of Ksh. 10,000/= per year. Dondi Otieno’s brother has
been living on the land but without the permission of Otieno. Discuss the various
interments that are held on Many be held by the parties.
