INSTRUCTIONS: Answer Question ONE and any other TWO.
1.
(a)
Mr. Ricky put up an advertisement on a local daily for a sale of a tractor atKShs3.8m. He gave a number through which interested parties could reach him. Z called the following day and said he accepted to buy the tractor at the stated amount. In the meantime however, Ricky changed his mind and decided to givethe tractor to his old man a gift on his 80th birthday. He is yet to transfer the tractor on the basis of the promise and the old man wishes to sell the tractor to his youngest son, Eli at half the price. Advise the parties as to any legal issues that may arise.(15 marks)

(b)
The sources of law in Kenya are a reflection of our history, culture and regal sovereignty. Discuss. (15 marks)

If the plaintiff wishes to establish a case under the rule of Ryland Vs Fletcher, he must prove certain essential elements. Discuss. (13 marks)
ii)
What defences are available to the defendant? (7 marks)

A complainant who intends to bring an action in court whether in the first instance or an appeal must consider carefully, the capacity of the court to deal with the matter. (20 marks)

Remedies for any breach of contract may lie in equity or at common law. Discuss. (14 marks)
