INSTRUCTIONS

This paper consists of five questions.
Answer questions 1 (Compulsory) and any other two questions.

1.
a)
Mr Abuko put up an advertisement on a local newspaper for a sale for a motorcar Ksh. 400,000. He gave a number through which interested persons could reach him. Y called on the following day and said that he accepted to buy the car at the stated amount. In the meantime however Mr. Abuko had changed his mind and decided to give the car to the niece as a gift. However, he’s yet to transfer the car to the niece Carol on the basis of the promise. Carol has offered to sell the car to Reuben for 250,000.
Advice the parties as to any legal issues arising. (20 marks)

b)
Using decided cases discuss the statement “every contract is an agreement, though not every agreement is a contract.” (10 marks)

2.
a)
Define a tort. (5 marks)
b)
Identify various types of torts while distinguishing torts from contracts. (15 marks)

3.
The sources of law in Kenya is a function of our historical, cultural and legal sovereignty. Discuss. (20 marks)

4.
A complainant who intends to bring an action in court whether in the first instance or on appeal must understand the capacity of the court, deal with the matter. Discuss various types of jurisdictions of the courts. (20 marks)
