INSTRUCTIONS.
Answer all Questions.
1. Give reasons for delegated legislation, briefly stating the validity in Kenyan courts.

2. Besides legislation, explore other sources of law in Kenya.

3. Discuss the hierarchy and corresponding jurisdiction of the Kenyan courts.

4. State the factors which undermine access to justice and the rule of law.

5. Clearly distinguish between valid, voidable and void contract.

6. In what ways may contracts be discharged?

7. Cathy recently bought a beauty parlour in the small town of Kamrongo from Doreen. Doreen told Cathy that the business had generated earnings of 750,000/+ during the previous year, and that in her view, it should do very well in the years to come. Doreen offered to show Carthy the financial records, but Cathy declined the offer. When Carthy asked why she was selling, Doreen told her: “I’m selling because I do not need to work anymore after my big win in ‘Kwachua Mamili’ last month.” Carthy believed everything Doreen said, but she also sought the advice of her best friend, Liz, who runs the hairdressing salon in the same town. Liz told Carthy: “there is a lot of money to be made out of ladies’ vanity hereabouts. It seems a good purchase to me”

Shortly after buying the beauty parlour, Carthy discovered that, while Doreen’s turnover for the years was indeed 750,000/=, the net profit for the business for the year was only 100,000/-. A few weeks later, Carthy also learnt that many of Doreen’s former customers had started going to a new parlour that Doreen had just opened in the neighboring town of Kajulu. Three months after the purchase, Carthy discovered that the lease on the beauty parlour was due to expire in one year, with no chance of renewal. Doreen had said nothing about this at the time of the sale.

Advise Carthy as to her legal position and any remedies that she may seek, if any.
