QUESTION 1
a) Liza has been an employee of Kenya Power and Lighting Company Limited for the last
seven months. Yesterday her employer terminated her services and offered to pay her one
month’s salary in lieu of notice and her accrued benefits which amount to Ksh 3450/=.
Her salary is Ksh 15,095/= per month. She thinks that the offer is not lawful owing to the
fact that it does not include her accrued annual leave. Explain to her what the law
provides regarding such leave in relation to an employee of her status, and calculate her
final dues, assuming the earlier offer had been worked out properly. (6 marks)
b) What classes of children do you find under the employment Act? What does the law
stipulate about them? (8 marks)
c) On Thursday last week, the Kenya National Union of Teachers’ secretary general was
aired on television uttering these words: “Let TSC know that we as a union are not going
to relent. The intended strike shall go on as planned and that body should not be misled
this time round that they will find it easy as before. The strike is lawful and we are set to
go on. We shall overcome!!!” Having listened to him, you are of the opinion that you
agree with him. Discuss why you are of this view. (7 Marks)
d) Under the Industrial Relations Charter the government is obliged to observe some things.
Discuss any four. (4 marks)

a) Discuss and explain any five negative steps which the colonial government took in the
implementation of the labour policies ( 10 marks)
(b) In the employment sector, good or sound relations are not easy to attain. Under what five
circumstances can you as the Human Resource Manager realize these relations? (5 marks)

QUESTION 3
a) Discuss three written sources of labour laws of Kenya. (9 marks)
b) An employee has some duties towards his employer. Discuss any three. (3 marks)
c) Clearly distinguish between temporary employment and probationary employment (3
marks)

QUESTION 4
a) The Kenyan employment law, specifically the Employment Act, Act no 11 of 2007 has
prohibited employers from making deductions to the extent which may burden an
employee. Discuss this opinion, starting with any seven lawful deductions, and how the
law stipulates these should be made in order not to cause an employee to strain. (8 marks)
b) Does the Central Organization of Trade Unions of Kenya have any functions in modern
Kenya? (7 marks)

QUESTION 5
a) Relate the annual leave and maternity leave as provided by the law of Kenya ( 5 marks)
b) In the event of an employer being faced with an industrial action by employees he has
remedies. Discuss any four. (8 marks)
c) Explain in detail when an employer is required to pay an employee money in lieu of
notice (2 marks)

QUESTION 6
a) You have been recently appointed a member of the National Labour Board, and the
Minister has called on you to discuss with the said Board the possible areas/ aspects they
may advise him over, as required by law. Prepare a report on the same. (6 marks)
b) In your view, having regard to the law, what is the worst form of child labour? (4 marks)
c) Prepare a memorandum outlining when employees of Zain Company Limited may be
summarily dismissed. (5 marks)
