Answer THREE questions. Question No. 1 is Compulsory, and you will be penalised for not answering it.

1. A fundamental aspect with which Constitutions the world over are associated with is the creation of order and frameworks for governance. Discuss this statement thoroughly in the light of the history of post-independence countries.

2. Recent constitutional reforms processes in Africa have been nothing more than window dressing exercises. Do you agree? Explain your answer giving concrete examples.

3. Taking into account all the constitutional reforms proposed by Kenyans during the failed Constitutional Reforms Process, which three key reforms in your view should be effected immediately by way of constitutional amendment, in order to address the reasons why Kenyans desired constitutional reforms in the first place?

4. Constitutionalism in Africa is a mirage. Do you agree? Discuss this statement in light of the theoretical and practical arguments regarding Constitutionalism.


5. Assess the Kenyan constitutional framework and judicial system thereof as a promoter and protector of human rights, the rule of law, and constitutionalism.
