Question 1
a) Sec 3(2) of the Judicature Act of 1967 provides that “the high court, the court of appeal and all subordinate courts shall be guided by African customary law in civil cases in which one or more of the parties is subject to it or affected by it, so far it is applicable and is not repugnant to justice and morality or inconsistent with any written law.” From the above provision of the judicature act, explain the following giving illustrations.

i) The courts are to be guided by African customary law.

ii) The customary law will only be applied if it is not repugnant to justice and
morality. (15marks)

b) Explain the functions of high court of Kenya. (10marks)

c) Daudi hired Mambo’s rooms for a series of lectures. Mambo however, discovered that the lectures to be conducted would be of seditious nature. He then refused to allow Daudi to use the rooms for the said lectures. Discuss the legal consequences of Mambo’s actions. (5marks)

Define the terms “sale and goods” and explain the law relating to transfer of property in goods. (15marks)

Explain the circumstances under which a partnership may be terminated. (15marks)
