1. Discuss the following ways in which an agency may be created:

a) Estoppel
b) Necessity
c) Ratification

2. a) Distinguish between an offer and invitation to treat.

b) Discuss the legal position in the following cases:

i) X offered to sell his land to Y for Shs. 2M. Y replied that he will buy for Shs. 1.5M but X refused. Ythen said he agrees to buy
X''s land for Shs. 2M, but X decided not to sell the land to Y but to T.

ii) A, an auctioneer, invited bids for certain goods. B bid for the goods and his bid was highest. But A refused to accept it.

3. a) What is misrepresentation? Discuss various types of misrepresentation and remedies for each of them.

b) D, a director of a company issued a prospectus for the company inviting public to buy shares in the company. The prospectus recited that the company
has a licence from a foreign manufacturer to manufacture certain types of goods in Kenya. Relying on this P bought shares in the company.
Subsequently P discovered that the company had no licence to manufacture goods in Kenya. He sued D.

Discuss the legal position.

4. Discuss the following sources of law:

b) Judicial precedent
c) Common law and Equity

5. Write explanatory notes on any TWO of the following:

a) Acceptance
b) Meaning and nature of law
c) Types of agent
