3. M was the employer of S, a lorry driver who was instructed by M on 27th November to collect lorry loads of sand and deliver them to M's work place. S was delivered one load of sand but on returning to collect a further load for delivering, he decided to go home to see his wife. On his way home, he was involved in a collision with T who was riding a bicycle and as a result of the collision T suffered personal injuries and damage of his bicycle. T plans to recover damages by a court action.
