1. What is an appeal in relation to the criminal process? Describe the legal requirements in
filing an appeal in court in Kenya. [30 Marks]

2. The principle of the right to legal representation is merely given lip service in Kenya criminal procedure, as the principle is only partially upheld. Discuss this statement and indicate whether you agree with it. [20 Marks]

3. Kajembe is arrested on a charge of robbery with violence and is held in custody in the police cells for questioning. Kajembe wants to be released on bail and makes that request to the sergeant in charge of the police cells. Discuss the legal principles involved.

4. Describe circumstances in which giving bail to an accused person would not be in the interests of justice. [20 Marks]

5. Discuss the principle that requires accused persons to be present in court at their trials and outline circumstances or exceptions where accused persons forfeit this right.
