1. One of the essential requirement of a valid contract is that the parties must have intention to create legal relations. Discuss.

2. Tim, his wife Ann and her friend Mary were living together in a flat in Nairobi. They use to buy a lottery ticket every week in the name of Tim from a common fund created by them for this purpose. Once they won the lottery and Mary asked for her share. But Tim refused on the ground that it was a social arrangement and therefore there was no intention to have legal concequences.
Discuss the legal position.

2. Discuss the following sources of Kenyan Law.
a) Constitution
b) Legislation
c) African customary law.

3. a) Examine various rules on making an offer.
b) Chebii made an offer to sell certain goods to Chemoi. The offer was to remain open for a month. Chebii revoked the offer after two weeks. Chemoi accepted the offer after three weeks. Chebii informed Chemoi that the offer has already been revoked.
Discuss the legal position.

4. Examine the following ways in which a contract may be discharged:
a) Agreement
b) Performance
c) Frustration.

5. Write explanatory notes on the following:-
a) Agency by ratification
b) Void, voidance, unenforceable and legal contracts.
c) Distinction between civil law and criminal law.
