Q1. Business transactions law students went for a shooting party at the Nairobi Orphanage in Langata. In the course of their game shooting. Nelson, one of the students was aiming to shoot a deer, but contrary to his intention he shot Leyla, one of the students in the arm. Leyla has sued Nelson. With the help of case laws:
a) What defence is available to Nelson? (10 marks)
b) What are the general defenses under law of tort? (15 marks)
c) Using illustration differentiate between ‘Injuria sine damnum’ and ‘damnum sine injuria’. (5 marks)
Q2. ‘A’ bought stationery worth kshs. 20000 from Honey stationers. He paid using a cheque that later bounced. Since the dishonor of the cheque, he has not made any efforts to pay Honey Stationers. What remedies can Honey stationers pursue? (20 marks)
Q3. “A hire purchase agreement is an agreement for the bailment of goods under which the bailee may buy the goods or under which property in the goods will or may pass to the bailee”.
a) Discuss the conditions and warranties as provided under section 8 of the hire purchase act. (10 marks)
b) What are the obligations of the hirer in a hire purchase transaction? (10 marks)
