Question ONE is compulsory

Q.1 i) Explain the difference between, specific and continuing guarantee. (5 marks)

ii) "The position of a finder of goods is exactly that of a bailxe in the case of a deposit". Comment in the above statement. (5 marks)

iii) Explain the duties and liabilities of a common carrier. (10 marks)

iv) M and D go into a shop. M says to the shopkeeper. "Let him (D) have the goods, and if he does not pay you, I will". Would it make any difference in your answer if M said to the shopkeeper, " "Let him have the goods, I will see you are paid". (5 marks)

2. Differentiate a bill of lading and Charter Party. (15 marks)
