Question One
a) Explain the purpose and rationale of labour legislation guidelines in an economy like Kenya.

b) Identify and explain the fundamental principles and rights at work as contained in the ILO
Declaration of 1998 (10 Marks)
c) Labour law has a law and somewhat unceremonious history. Central to the understanding of the
struggle between labour and management is the understanding of the roles the courts played in
shaping the labour policy before the country enacted legislation that forms the basis for labour
relations today. How did the businesses manage to control the early forms of unions prior to the
genesis of today’s labour laws? (10 Marks)

a) Elaborate on the following labour relations terminologies:

iii. Labour Law (3 Marks)

b) In May 2001 a Taskforce to review the Labour Laws was appointed by the then Attorney General
(Gazette Notice No. 3204), within an International Labour Organisation project. Expound on each
of the terms of reference for the Taskforce they were. (10 Marks)
Question Three
a)An employer may not discriminate against an employee who has filed previous workers’ compensation
claims. Analyse the suspect behaviors about an employee present or observable in an emerging
pattern, requiring investigation for possible fraud. (10 Marks)
b) The effective implementation and enforcement of minimum age legislation requires sanctions for
violators of minimum age laws, proper investigation to identify the existence of child labour and
effective inspection of workplaces. The legislation for minimum age provisions should be enforced
through a number of sanctions. What provisions would you take care of in this aspect? (10 Marks)

a) Discuss the fundamental significance of the freedom of association in labour relations
management. (10 Marks)
b) Explain the role of Government of Kenya in securing freedom of association in line with ILO
Conventions. (10 Marks)

a) What will be your functions as HR in Labour Relations? (10 Marks)
b) Labour relations processes consist of the approaches and methods employed by the employer to
deal with the employees may be, individually or collectively through their trade unions. What
makes up the LR processes? (10 Marks)
