1. (a) Discuss the nature of employment contract by distinguishing between a contract, a
contract of service and contract for service. [10 Marks]

(b) Critically evaluate the provisions of the Employment Act, 2007 in relation to
termination of employment. [10 Marks]

(c ) Discuss the duties of an employee under the occupational Safety and Health Act 2007. [10 Marks]

2. (a) In the recent months there have been strikes of workers demanding salary
increase, you have been approached as an official of the trade union, discuss ways in which such disputes could be resolve. [10 Marks]

(b) Discuss the major sources of Kenyan labour law. [10 Marks]

3. (a) Explain the following terms as applied in labour law giving illustrations;

(i) Redundancy

(ii) Occupier

(iii) Lock out

(iv) Strike

(v) Wrongful dismissal [10 Marks]

(b) Discuss the role of international labour organization in setting labour standards in
Kenya. [10 Marks]

4. (a) Discuss the objectives of trade unions as stated under the Labour Relations Act
2007. [10 Marks]

(b) Elaborate the deductions that an employer may make from the wages of an
employee under sec 19(1) of the Employment Act 2007. [10Marks]
