i.Case:Chaplelton vs Barry UDC(1940)-Chaplelton hired a deck chair from the defendant,paid four pence s and obtained a ticket,which he put into his pocket without reading what was on it.It was printed on the back that the defendant will not be liable for any accident or damage arising from us of the chairs.
ii.L’estrange vs Graucob 1934-L’estrange brought an automatic cigarette vending machine from Graucob.He signed a document which contained a number of clauses in small print among them a clause any express or implied conditions,statement of warranty,statutory or otherwise is hereby excluded.The plaintiff did not read the relevant clause and she refused to pay the price on the grounds that the machine did not work. 5mks
